Spanish Inheritance Tax for Non-Resident Heirs

Spanish inheritance tax · Heirs living abroad

Living outside Spain does not by itself remove Spanish inheritance tax obligations. Start with where each beneficiary is tax resident, what they receive and where the deceased lived. Those facts help determine what is taxable, which rules can apply and where to file.

There is no single tax percentage for every non-resident heir. Before relying on an advertised allowance or relief, check that it applies to your relationship, assets and circumstances.

Ask about your inheritance tax position

Who pays Spanish inheritance tax?

Under Spain’s general inheritance tax framework, the taxpayer receiving an inheritance or legacy is the individual beneficiary. Each person’s position must be assessed. Two siblings inheriting from the same parent may have different filing circumstances because they live in different countries.

A person treated as resident in Spain for this tax is generally taxed on their inheritance wherever the assets are located. A non-resident is instead taxed on the acquisitions with a Spanish connection described in Article 7 of the Inheritance and Gift Tax Law: assets and rights situated, exercisable or to be fulfilled in Spain, and certain life-insurance proceeds.

A Spanish property is therefore a clear reason to check the Spanish filing position. Nationality and residence are different questions: a British passport does not determine tax residence, and the residence of the deceased does not replace the residence test for the beneficiary.

This guide addresses the general state and common-regime framework. Foral tax regimes require their own examination where relevant.

Can a non-resident use regional inheritance tax rules?

Yes, where the statutory connection rules give that entitlement. The second additional provision of Law 29/1987 provides access to the relevant autonomous community’s rules in specified international situations, including those involving third countries.

Two common situations under the general framework
The deceased’s positionRegional connection to examine
The deceased was non-resident in Spain. The autonomous community containing the greatest value of the estate’s assets and rights situated in Spain. Where there are no Spanish assets or rights, the provision refers to the community where each taxpayer resides.
The deceased was resident in a Spanish autonomous community and the heir is non-resident.The rules of the autonomous community where the deceased was resident, determined under the relevant statutory residence test.

The region follows the legal connection rules. It is not a free choice of whichever region offers the largest reduction. The relevant residence test also needs more than a last postal address: the provision uses the longer period spent in a community during the preceding five-year period for its territorial residence rule.

The office managing the return and the tax rules used in the calculation are separate questions. A return handled by the national tax authority can still apply the connected regional rules where the taxpayer is entitled to do so.

What about heirs living in the United Kingdom?

Living in the UK does not, by itself, exclude an heir from the regional rules available under that provision. The estate’s connections and the requirements of the particular relief still need to be checked. This is distinct from whether English succession law governs who inherits.

What is the Spanish inheritance tax deadline?

Under the state filing rules, the ordinary deadline is six months from the date of death. The date on which a grant is issued abroad or a Spanish inheritance deed is signed is not the starting date for that ordinary period.

An extension for a further six months can be requested within the first five months. If it is granted, interest runs from the end of the original six-month period until filing. Confirm the competent office and procedure early enough to submit a valid application.

A filing extension and an arrangement to defer or pay the tax by instalments are different matters. If the estate has little available cash, raise that issue while the calculation is being prepared.

What if the deadline has already passed?

Gather the date of death, any extension application, any return already filed and any tax correspondence. The response depends in part on whether the authority has already contacted you and what remains outstanding. Ask for a review of those facts so the next step addresses the actual position.

How is inherited Spanish property valued?

For real estate under the general statutory rule, check the cadastral valor de referencia applicable on the tax accrual date. If the declared value is higher, that higher value is used. If no reference value exists or it cannot be certified, the rule uses the higher of the declared value and market value, subject to administrative verification.

The valor de referencia and the valor catastral appearing on the local property tax bill are different figures. Identify the correct property and valuation date before using either document.

If the reference value appears to overstate the property’s position, obtain evidence and examine the statutory challenge procedure. The tax calculation should reflect the ownership share acquired, the nature of the rights and the deductions legally available.

What changes the amount payable?

  • The value and nature of what each person receives.
  • Their relationship to the deceased and other qualifying personal circumstances.
  • Legally deductible liabilities and charges.
  • The applicable state or regional rules, including any conditions attached to relief.
  • Factors relevant to the calculation, such as the beneficiary’s existing wealth where applicable.

A headline percentage cannot answer all of these questions. An exemption, reduction or rebate also needs to be distinguished from the obligation to submit the required return.

A Spanish property may raise separate municipal tax questions. A later sale has its own tax consequences. Keep those items separate from the inheritance tax calculation.

Which return and documents are needed?

For inheritance acquisitions administered by the national tax authority, the relevant self-assessment is normally Modelo 650. Confirm the competent authority before selecting a form or filing route.

The succession and identification documents, inventory, valuations and any claimed deductions must support the return. The required Spanish tax identification and any representation arrangements should be organised early, especially when the beneficiary lives abroad.

Prepare these facts for your review

  • The date of death, the deceased’s residence history and your own country of tax residence.
  • Your relationship to the deceased and your expected share.
  • The assets and rights inherited, their locations, ownership shares and values.
  • Documents supporting any liabilities or deductions to be claimed.
  • The property’s cadastral reference and available valuation information.
  • Any Spanish or foreign tax return, extension request, assessment or payment already made.

If another country also taxes the inheritance, the interaction needs a separate review under the relevant domestic rules and any applicable treaty. Keep copies of both countries’ calculations and payment evidence.
